Chapter 7 bankruptcy is known as “liquidation bankruptcy.”  Tennessee has a generous $10,000.00 personal property exemption, along with other specific exemptions (retirement accounts, clothing, tools of the trade, etc.) and most (the vast majority) of my clients don’t lose anything in a Chapter 7 bankruptcy.  Yes, you can keep your house and you can keep your car with a reaffirmation agreement.

Chapter 13 bankruptcy is known as “debt consolidation” or “repayment” bankruptcy.  We create  plan that categorizes your debts (priority, secured, unsecured) and we create a plan – the Chapter 13 plan – to deal with them.  You make one weekly, bi-weekly or monthly payment to the Chapter 13 Trustee.
